Terms of Service
The general terms and conditions of the online store are formulated in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), based on the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS), international codes for e-commerce, and the General Data Protection Regulation (GDPR) of the EU.
The online store is operated by Ergonomske rešitve d.o.o., Radvanjska cesta 76, 2000 Maribor (hereinafter referred to as the “provider”). The company is a VAT payer, VAT ID: SI59147504, and the director of the company is Rade Stamenkovič.
These general terms and conditions cover the operation of the online store, the rights of the user, and the business relationship between the provider and the customer.
By confirming the order, the user acknowledges the general terms and conditions, the privacy policy, and the legal notice.
Payment Methods
The provider offers the following payment methods:
- Cash on Delivery
Payment with cash upon receipt of goods. For cash on delivery payments, we charge shipping costs according to the current price list of Pošta Slovenije or the GLS delivery service. - Payment via proforma invoice (transfer to the provider’s transaction account). If you choose to pay via proforma invoice, you will receive the invoice by email (it is not generated automatically but sent with a delay). Once the invoice is fully settled, you will receive the ordered goods. If the invoice is partially paid, the goods remain the property of Ergonomske rešitve d.o.o. until the full payment is received.
Delivery Times and Methods
The online store accepts orders 24 hours a day. All orders received from Monday to Friday by 12 PM will be processed on the same day. Orders received after 12 PM will be processed on the next business day. Orders received on Saturdays, Sundays, and holidays will be processed on the first business day thereafter. If a product is out of stock at the time of ordering, the delivery time will be extended according to the supplier’s delivery schedule.
Our contractual partners for delivery are Pošta Slovenije and GLS, but the provider reserves the right to choose another delivery service if it can fulfill the order more efficiently.
Prices and Delivery Costs
All product prices in the online store are listed in Euros (€).
Prices are valid at the time of order submission and do not have predetermined validity.
Prices are valid for payment methods specified above and under the stated conditions. Despite efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In such a case, or if the price of a product changes during the processing of an order, the provider will allow the customer to cancel the purchase while also offering a mutually satisfactory solution.
The purchase contract between the provider and the customer is concluded at the moment the provider confirms the order. From that moment, all prices and other conditions are fixed and apply to both the provider and the customer.
Shipping costs are charged according to the current price list:
- Pošta Slovenije: When paying for the shipment upon delivery, an additional commission fee is charged according to the current price list. This fee is not included in the order value.
- GLS: No commission fee.
The listed shipping costs apply to domestic shipments within Slovenia. For international shipping, the current price list of Pošta Slovenije and GLS for international traffic applies.
Personal Pickup
Products purchased in the online store can also be picked up in person with payment upon pickup or with proof of payment to the provider’s transaction account.
Warranty
Products come with a warranty if stated on the warranty card or on the invoice. The warranty is valid upon following the instructions on the warranty card and presenting the invoice. Warranty information is also provided on the product presentation page. If there is no warranty information, the product either does not have a warranty, or the information is currently unknown. In such cases, the customer can contact the provider.
The provider is legally obligated to offer a warranty for the proper functioning of the purchased goods. The customer can claim the warranty directly with the provider, using the warranty card and invoice.
The provider must complete the warranty repair within 45 days of receiving the goods. If not, the product must be replaced with another, equivalent, and flawless product. Returning goods under warranty is carried out according to the conditions.
Warranty Conditions for Ergos Chairs
The seller, Ergonomske rešitve d.o.o., Radvanjska cesta 76, 2000 Maribor, guarantees the quality and ensures the flawless operation of the product within the warranty period of 36 months, starting from the delivery of the product. The warranty is valid with the original invoice.
The warranty does not apply in the following cases:
- If the defect occurred due to mechanical damage caused by the buyer or a third party,
- If the defect or damage occurred due to improper assembly or use, or if the owner or a third party did not follow the provided instructions,
- If the repair was performed by an unauthorized person,
- If the defect occurred due to force majeure (floods, fire, etc.),
- If the damage resulted from improper, negligent, or prolonged use.
Ergonomske rešitve d.o.o. declares that it will ensure the flawless operation of the product within the warranty period, under the following conditions:
- The defect or fault was reported to the company’s headquarters,
The product was returned to the company’s headquarters, - The product was used exclusively in accordance with the provided instructions for use,
- The warranty does not exclude consumer rights arising from the seller’s liability for defects in the goods.
The period after the expiration of the warranty during which the seller guarantees maintenance of the product and replacement parts is at least 3 years.
Right of the Consumer to Withdraw from the Contract
For contracts concluded at a distance or outside business premises, the consumer has the right to notify the provider within 14 days that they are withdrawing from the contract, without having to provide a reason for their decision. The consumer only bears the cost of returning the goods in connection with the withdrawal from the contract.
For a sales contract, the withdrawal period from the previous paragraph starts on the day the buyer receives the goods.
The buyer notifies the provider of the withdrawal from the contract via the email address: info@ergonomske-resitve.si or by mail to the address: Ergonomske rešitve d.o.o., Radvanjska cesta 76, 2000 Maribor. In case of withdrawal from the contract, the buyer returns the received goods in person or by mail to the provider’s address no later than 14 days after the notification. It is considered that the buyer returns the goods on time if they send it before the 14-day return period expires.
The consumer must return the goods to the provider undamaged, unless they are damaged or faulty without the fault of the consumer. The buyer is allowed to inspect and test the goods to the extent necessary to determine the actual state. The consumer does not have the right to withdraw from the contract if the product was made to order and differs from the standard offer.
Returning the goods to the provider within the withdrawal period is considered as notification of withdrawal from the contract.
In case of withdrawal from the contract, the provider will immediately, or no later than 14 days after receiving the notification of withdrawal, return the received payments. The provider will return the received payments to the buyer’s transaction account. For sales contracts, the seller may withhold the refund of received payments until the returned goods are received.
Protection of Personal Data
We understand that the privacy of visitors and customers in our online store is paramount. Therefore, we ensure the protection and safeguarding of your personal data in accordance with the Personal Data Protection Act (ZVOP-1) and the General EU Data Protection Regulation (GDPR).
Please read the declaration carefully before giving consent for the processing of personal data.
Personal Data and Purpose of Processing:
Registration in the online Store: By registering in the online store, you agree that your personal data will be stored and used exclusively for the purposes of fulfilling your order (sending invoices, delivering goods) and other necessary communication. Personal data obtained through registration in the online store includes: name, surname, address, contact telephone number, and email address. In the case of registering a legal entity, the company name and tax number are also collected. If a purchase is made, we also process data about the orders.
We will keep your data in the personal data collection until you withdraw your consent for the processing of personal data or as long as necessary to achieve the purpose for which they were obtained.
Newsletter Subscription: If you wish to receive newsletters, you must fill out the form on our website: www.ergonomske-resitve.eu/brezplacni-prirocnik/. By completing this form and confirming, you provide the following contact information: name and email address. We will forward your data for this purpose to our newsletter service provider, MailChimp (The Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, Georgia 30308, USA), and use it exclusively for sending our newsletters. MailChimp is based outside the EU, in the USA, which is considered a country without an adequate level of data protection. To ensure the security of your data, MailChimp has a certification from the US Department of Commerce under the EU-US Privacy Shield program. Unsubscribing from Newsletters: When you have given your consent for the processing of your personal data for a specific purpose, you always have the right to withdraw that consent at any time. The withdrawal or modification of consent applies only to data processed based on the consent. The provider commits to permanently protecting all user personal data. User data will not be disclosed to unauthorized persons, except to contractual partners for the delivery of goods.
Consumer Rights: By submitting a written request to the email address info@ergonomske-resitve.si, the consumer can request to unsubscribe, access, supplement, correct, restrict processing, transfer, and delete their personal data. The user is also responsible for protecting their personal data by ensuring the security of their username and password.
Cookies
Our website uses cookies for its smooth operation, which are stored on the user’s device. Cookies are small files that we place on your computer to identify the individual devices you used to access.
Using website cookies is common and desirable. They enable a higher level of services, such as saving registration confirmation, using the online store, preventing excessive display of banner ads, and similar. Interaction between the web user and the website is faster and easier due to them. With their help, browsing websites is more efficient and user-friendly.

- Investigate how visitors navigate the site to customize content display based on past visits,

Disclaimer
The provider strives to ensure the timeliness and accuracy of the data published on its pages to the best of its ability. However, product features, delivery times, or prices may change so quickly that the provider is unable to update the information on the website in time. In such cases, the provider will inform the customer of the changes and allow them to cancel the order or replace the ordered product.
Although the provider tries to ensure accurate photographs of the products for sale, all photographs should be taken as symbolic. The photographs do not guarantee the product’s characteristics.

The online store is owned and operated by Ergonomske rešitve d.o.o. The content published in the online store is the property of Ergonomske rešitve d.o.o. and may be used for non-commercial purposes, provided that all copyright notices are retained and not copied, reproduced, or otherwise distributed without the permission of Ergonomske rešitve d.o.o.
Occasionally, we may not be able to ensure the complete accuracy and reliability of all published data. We will take all warnings seriously and immediately correct any published information. We are not responsible for any consequences arising from the use of information published in this online store or from temporary non-operation of the online store. We reserve the right to make daily changes to content, price errors, and written text. By using the online store, the visitor or customer confirms that they accept and agree with the described terms.
Complaints and Disputes
The provider respects the current consumer protection laws. The provider strives to fulfill its duty to establish an effective complaint handling system and designates a person who the customer can contact in case of problems, either by phone or email. Complaints can be submitted via email at info@ergonomske-resitve.si or by phone at 02/320-30-77.
The provider will confirm receipt of the complaint within five working days, inform the customer about the duration of the complaint process, and keep them updated on the progress.
The provider will endeavor to resolve any disputes amicably.
